This webinar examines the considerations and options, from both a legal and practical perspective, for companies facing financial uncertainty or difficulty, particularly as the Government’s COVID-19 business support measures come to an end. The course focuses on the options available at a time when many companies are faced with some stark decisions about their ability to trade forward. This webinar includes sample case studies, where appropriate.

Course Overview

  • Is a company insolvent? Practical and legal tests and considerations, and key factors in assessing a company’s viability post COVID-19
  • Directors’ duties when a company is in financial uncertainty and practical tips and pitfalls, also covering ODCE’s recent guidance to company directors
  • Restructuring options, particularly Examinership and Schemes of Arrangement, Creditors’ Voluntary Liquidations and Court Liquidations, as well as Receiverships

By the end of this course, participants will be able to:

  • Understand company insolvency from a practical and legal perspective and the implications that can flow from that
  • Be informed as to what are directors’ duties in times of financial uncertainty
  • Understand the restructuring options available to companies in financial difficulty
  • Understand other options available including CVLs and receiverships
  • Be in a better position to advise clients in assessing whether their business is viable post COVID-19

Speaker Bio’s

Jamie Ensor, Partner, Dillon Eustace-Jamie specialises in Insolvency and Corporate Recovery law and acts for insolvency practitioners, secured and unsecured creditors, companies, shareholders and directors in all aspects of insolvency and corporate recovery, including examinerships, receiverships, liquidations and bankruptcies. He has extensive experience in complex litigation before the superior courts arising from insolvency appointments. Jamie has lectured on the Professional Practice Courses 2 (Law Society of Ireland)

Ian Barrett, Director, KPMG Restructuring, Deal Advisory- Ian has 15 years’ experience of providing restructuring advice, managing large scale insolvencies and undertaking business reviews of underperforming businesses on behalf of key stakeholders. Ian has worked on some of the largest insolvencies in Ireland and has significant experience of receiverships, creditors voluntary liquidations, court liquidations, members voluntary liquidations and examinerships across a wide range of industries
